Terms of Use for T Guide

  • 1. Introduction These Terms of Use define the terms and conditions for using the software application known as "T Guide" (hereinafter referred to as the "APP"). The APP is provided by Mi Guia S.r.l. Using our services implies the acceptance of these conditions. If you have any questions or concerns, we encourage you to contact us before registering an account on T Guide at the email address curtainup@tguide.me. Please note that we may make changes to these Terms of Use, and we will inform users through the APP. Using our services after any updates to the Terms implies acceptance of the changes.
  • 2. Who We Are We are Mi Guia S.r.l., with our legal office at Via de’ Serragli 18, 50124 Florence, Italy. Our VAT number is IT 07232300488, and you can contact us via email at curtainup@tguide.me.
  • 3. Purpose of the APP The T Guide APP has been developed with the goal of promoting theatrical shows by providing users with a selection of shows accompanied by promotional video trailers, a schedule of performances, and other information to facilitate the choice for viewers, including details about the theaters where the performances take place. The schedule is compiled in collaboration with partners, including magazines, event organizers, distributors, press offices, theater websites, and theater companies, among others. T Guide carefully selects these partners to create a unique experience for users. Our primary goal is to support artists, producers, distributors, and theater space managers in increasing ticket sales, regardless of the chosen sales channel. Please note that T Guide does not operate as a ticketing platform but rather as an informational, promotional, and performing arts dissemination platform.
  • 4. General Description of Services
    • 1. To provide access to the services described below, we need to collect, process, and store data, including, at times, personal data, in accordance with these Terms of Use and the Privacy Policy.
    • 2. Registered users can access a complete schedule of shows, view promotional trailers, search for shows, theaters, and artists, save shows in personal lists, access ticket purchase links, set reminders, and follow theater and artist updates.
    • 3. PRO users, such as artists, theater space managers, producers, distributors, etc., can enrich their profiles and manage associated shows, venues, and promotional content. They must provide accurate data to verify the association between shows, theaters, and the user.
    • 4. Services also include personalized recommendations for shows, events, and promotions based on user preferences and usage data. These recommendations can be viewed in the "Recommendations for You" section on the home page for generic users and in the "PRO Content" section for professional users. Users can also access ticket purchase links and share events, shows, or collections with other users.
    • 5. PRO users can directly manage content related to associated shows and theaters. They are responsible for the published content and must comply with copyright laws, intellectual property rights, trademarks, and copyrights.
  • 5. Account Deletion and Closure
    • 1. Registered users can stop using the services at any time, deactivate their accounts, or request account deletion in the user area of the APP or by contacting us directly at the email address dpo@tguide.me.
    • 2. In the event that we determine a user's violation of these Terms or applicable legal provisions, we reserve the right to suspend or close the user's account at any time and without notice.
  • 6. Published Content
    • 1. The content published on T Guide in collaboration with partners, such as magazines, theater companies, press officers, producers/distributors, is their property and is within the APP. Such content is protected by copyright and other copyright-related laws, as well as current regulations.
    • 2. When partners provide the necessary data for publication on T Guide, they declare that they are the legitimate rights holders of such content or have obtained all necessary permissions for publication.
    • 3. Furthermore, the rights holders are informed of the decision to promote their shows on the APP and are given tools to access and manage existing content, as well as to add new content when possible.
    • 4. Users are not allowed to publish material that does not meet the following requirements: It must be accompanied by a video trailer following the process described in point 4. It must include a schedule of performances and a link to a ticketing website where viewers can obtain access to the show. With specific exceptions, PRO users who have subscribed to a membership or have been selected by T Guide or T Guide's editorial choice may publish incomplete content, with visibility limitations for PRO users or specific identified categories, for example, for promoting preview performances.
    • 5. PRO users, enabled to upload or manage content associated with them, have the right to request the deletion or modification of such content by us. They can also directly add or modify new content or information in the application, provided that such content is not illegal, obscene, intimidating, defamatory, discriminatory, objectionable, pornographic, abusive, politically propagandistic, commercially solicitous, or violates privacy or intellectual and industrial property rights of Mi Guia or third parties, or is otherwise harmful to us or third parties.
    • 6. We reserve the right to delete, move, or modify content that, in our sole discretion, we deem illegal, abusive, defamatory, obscene, or in violation of copyright or otherwise unacceptable.
    • 7. It is strictly prohibited to use an email address that does not belong to the user, appropriate personal data or credentials of another user to impersonate that user or provide false information about the origin of the content.
    • 8. Users undertake to provide truthful descriptions of published content, including, for example, technical artistic details and information regarding the schedule, theater, and ticketing. Promotional material and show trailers undergo a process of adaptation to ensure an optimal experience for the application's users. This process includes the automatic selection of the first 30 seconds of the trailer in case the original trailer is longer. Subsequently, the video is adapted to the 9:16 vertical format for optimal viewing within the application, with the central frame selection if the original material is presented in a horizontal format. The resulting 30-second trailer video can be modified, replaced, or removed at the discretion of authorized users. However, T Guide reserves the right to evaluate the quality of video material provided by users and decide whether to publish it, taking into account minimum standards such as a resolution of at least 720p, audio quality, and image quality.
  • 7. Disclaimer
    • 1. The application is provided "as is" and "as available." We cannot guarantee that the services will be compatible with all mobile devices or the software used on the devices, available at any specific time, or entirely accurate and up to date, despite our efforts. We are not responsible if the provided information is inaccurate or if the uploaded material is incorrect. We guarantee modification or removal within 48 hours of receiving the report.
    • 2. We strive to keep the application available 24 hours a day, but we cannot guarantee uninterrupted and continuous access for reasons such as system failure, maintenance, repairs, or events beyond our control.
  • 8. Limitation of Liability
    • 1. We are liable only for losses or damages directly caused by our negligence or non-compliance with the terms of use, purchase conditions, or privacy policy. We are not responsible for indirect losses or damages, such as loss of profit, business, goodwill, reputation, or data resulting from the use of our services, materials available through the services, or services related to those provided by us. We are not responsible for device failures, errors, delays, or interruptions in the operation of the services caused by the incorrect use of the application by users or third parties, nor for events beyond our reasonable control. Furthermore, we do not assume any obligation or responsibility regarding the copyright of content uploaded to the application, including any legal costs incurred for defending against legal actions.
    • 2. These terms of use take precedence over the rights of the user as provided by law unless prohibited by the law itself.
  • 9. Linking to Third-Party Websites
    • 1. The application may contain links to third-party websites. However, we do not exercise any control over them and are not responsible for their content.
    • 2. Some of these links may direct users to third-party websites offering services through the application. In such cases, the general terms of use and specific terms of service provided by third parties for using the site and accessing services will apply. We assume no responsibility for such terms and conditions provided by third parties.
  • 10. Invalidity of Individual Clauses
    • 1. In the event that any provision of these Terms is found to be illegal or invalid, that provision will not be considered part of the General Terms. This circumstance will not affect the remaining provisions, which will remain valid to the maximum extent permitted by law.
  • 11. Privacy
    • 1. The protection and processing of personal data will follow the rules and provisions of the Privacy Policy published in the application.
  • 12. Applicable Law and Competent Jurisdiction
    • 1. These Terms and any disputes regarding the execution, interpretation, and validity of this contract are subject to Italian law and the exclusive jurisdiction of the courts of the Italian Republic.

In accordance with Articles 1341 and 1342 of the Italian Civil Code and Article 33 of Legislative Decree September 6, 2005, No. 206 (Consumer Code), the user expressly agrees to the following conditions:

  • Paragraph 8.1, 9.1, 9.2, which concern limitations of liability.
  • Paragraph 5.2, relating to account cancellation.
  • Paragraph 12, which deals with applicable law and competent jurisdiction.
